1. Scope of the Terms of Service
This agreement is an automatic renewal entrustment deduction service (hereinafter referred to as "Service") provided by Juphoon between Dual Chat members (hereinafter referred to as "Member") and Ningbo Juphoon System Software Co., Ltd. (hereinafter referred to as "Juphoon"). An agreement that describes the rights and obligations of Dual Chat and its Members regarding the use of the Service and related aspects. “Member” means an individual or a single entity that enjoys the membership services provided by Dual Chat. This agreement constitutes a prerequisite for the use of the Service provided by Dual Chat by the Member (whether by the individual or the entity), and the Member shall not be entitled to use the Service unless the Member accepts the terms of this agreement, and the Member's choice to use the Service shall be deemed to be agreed to be accepted by this agreement and the terms of the article.
2. Service Description
2.1 This Service is based on the Member's need for automatic renewal. Under the premise that the Member has opened the Service, the loss will be avoided if the Member fails to renew the account due to negligence or other reasons. The Member irrevocably authorizes Dual Chat to renew the iTunes account (hereinafter referred to as "account") for the next billing period member service and debit the account when the membership is about to expire.
2.2 Automatic renewal refers to: Based on the premise of 2.1, Dual Chat automatically renews the next billing period membership service for Members. The Member must ensure that Dual Chat can debit the account successfully. If the renewal fails due to the Member's personal account problem, the Member is responsible for it.
2.3 The Service offered by Dual Chat to Members are limited to the use in Dual Chat application. Any malicious means such as malicious cracking that separate the Service provided by Dual Chat from the Dual Chat application is not the one agreed in this Agreement. All legal consequences arising therefrom are the responsibility of the perpetrator, and the Dual Chat team will pursue the legal liability of the perpetrator.
3. Rights and obligations
3.1 Dual Chat is responsible for providing Members with inquiries regarding the specific circumstances of automatic renewal fees, but is not responsible for printing relevant invoices and forwarding them to Members.
3.2 After Dual Chat successfully deducts the next billing cycle fee from the Member account, it usually takes effect on the same day, and the Member expiration date is extended accordingly. The rules set by Dual Chat shall prevail.
3.3 If there is an error in the renewal process, Dual Chat and the Member shall closely cooperate to ascertain the reasons and each shall bear the losses caused by their own faults; if the losses are caused by the unequal ambiguity of the two parties, the two parties shall bear corresponding responsibilities according to the degree of fault; If both are responsible, the two parties shall share the responsibility.
3.4 The Member can decide whether to cancel the Service or not. If the Member chooses not to cancel, the Member is deemed to have agreed to Dual Chat to renew the subscription according to certain rules.
3.5 If the price of Dual Chat Member Service is adjusted at / before the automatic renewal, the price you agreed to when subscribing shall prevail.
3.6 Dual Chat may modify and change the relevant rights and interests of the Service, charging standards and methods according to the overall planning, business development or technical upgrade of the Member function. Dual Chat will post the changes in the Dual Chat application or on the relevant pages before making any such changes, but is not obligated to make individual notices. If Members need to obtain and use this Service, please know in advance the information about the relevant rights and interests of the Service, the charging standards and methods. If the Member does not agree to the modification of this agreement, the service that has been acquired may be cancelled and the use will be discontinued; if the member continues to use the service provided by Dual Chat, it is deemed to have accepted all the modifications of this agreement.
4. Agreement validity period, change, suspension or termination
4.1 This agreement shall become effective after the Member chooses to accept or use the Service until the termination of the Service/Revocation of membership.
4.2 Members have the right to terminate this Service at any time in the settings. Upon termination of this Service, Dual Chat will stop providing this Service to Members.
4.3 The order that the member has entrusted Dual Chat to renew the subscription before the termination of the Service is still valid. Dual Chat will not refund the purchase fee generated based on the instruction, and the member shall bear the relevant responsibility.
4.4 Members should fully understand and agree that due to the particularity of Internet services, Dual Chat may suspend or terminate the provision of the Service to Members in accordance with relevant regulations, mutual agreement or other circumstances, and Dual Chat will protect the legitimate rights and interests of users in accordance with the law.
5. Liability for breach of contract
If one party breaches the contract, the observant party has the right to obtain compensation through the dispute resolution method agreed by both parties.
6. Dispute resolution
Dual Chat and its Members shall resolve the dispute arising from the implementation of this agreement through friendly negotiation. If it cannot be resolved through negotiation, either party has the right to submit the dispute to the people's court with jurisdiction in the place where the agreement is signed.
7. Place of agreement
The signing place of this agreement is Yinzhou District, Ningbo City, Zhejiang Province, the People's Republic of China.
8. Applicable law
The establishment, entry into force, performance, interpretation and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China.
9. Cancellation
For iOS users: Manually turn off the auto-renewal function within 24-hours prior to the end of the current period: "Settings" → "iTunes Store and App Store" → "Apple ID" → "View Apple ID" Settings page Click "Subscribe" → Cancel Dual Chat Premium or Dual Chat Premium subscription.
For Android users: Go to Google Play: "Account" → "Subscriptions" → Cancel Dual Chat Premium or Dual Chat Premium subscription.
